Public procurement in Poland

A new public procurement law

The market of public contracts in Poland develops dynamically.  A constant increasing number of notices and value of awarded contracts is noted.  More and more foreign companies are entering the Polish public contract market.  The favorable market conditions create opportunities for foreign companies to expand their business operation in Poland. 

According to the EU directive of 26th of February 2014 on public procurement Poland needs to implement most of its provisions before 18th of April 2016.  The Polish government postponed many regulations such as the one that requires carrying out orders only by e-mail till 2018. The government draft amendment on public procurement law, which aims to implement this directive, went to public consultation.

As time till the 18th of April 2016 is short, the government - although considering a new law - decided to prepare an amendment on the public procurement law – so for now there will be no new law on public procurement in Poland. This may be a good short term solution but ultimately a new law will be essential.
